These Terms of Service (“Terms”) govern your use of the Bar & Resto Menu mobile application (“the App”) developed and licensed by Q&A IT (“we,” “us,” or “our”). By downloading, installing, activating, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Bar & Resto Menu is a commercial Android application for restaurants, cafés, and bars. It provides digital menu management, table-side ordering, kitchen display, ingredient tracking, and sales analytics.

Subject to your compliance with these Terms and payment of the applicable license fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App according to your subscription tier.
To use the App after the trial period, you must purchase a license and activate it within the App. Activation requires internet connectivity and binds the license to your device.
The App periodically verifies your license with our servers (approximately every 30 days) when an internet connection is available. This runs silently in the background.
If the App cannot verify your license (for example, due to a payment failure or extended period without internet), a 15-day grace period begins. After the grace period, the App will require internet connection and re-verification to continue functioning.
Each license is bound to specific devices through an anonymized hardware fingerprint. Uninstalling and reinstalling the App, or resetting your device, does not bypass license requirements.

Violating these restrictions may result in immediate termination of your license without refund.
Current pricing is displayed on our website. We reserve the right to change pricing for new purchases. Existing licenses are honored at the price purchased.
Payments are processed by third-party payment providers (currently Paddle and others). All charges are in US Dollars unless otherwise specified. Applicable taxes are calculated and collected by our payment provider based on your location.
Monthly and yearly subscriptions renew automatically using the payment method on file. You can cancel renewals at any time through the payment provider’s portal or by contacting us. Cancellation takes effect at the end of the current billing period.
If a renewal payment fails, we will notify you (if your email is on file) and grant a 15-day grace period during which your license remains active. After the grace period without successful payment, the license becomes inactive. You can contact us at [email protected] to extend the grace period if needed.
Our refund policy is set out in our Refund Policy, incorporated by reference into these Terms.
We may release updates that add features, fix bugs, improve performance, or address security. Updates are delivered through Google Play Store.
We may modify or discontinue features. We will provide reasonable notice for material changes that affect your use of the App.
If we discontinue the App entirely, we will provide at least 90 days’ notice. Active subscribers may be entitled to a pro-rata refund of unused subscription time.
You own all data you create within the App (menu items, orders, sales records, etc.). The App stores this data on your devices. We do not have access to your business data unless you voluntarily share it (for example, in a support request).

You are responsible for backing up your data. The App provides export features for this purpose.
The App uses Google Nearby Connections and other Android services for its functionality. Your use of these services is also subject to the respective third-party terms. We are not responsible for third-party services.
The App, including its source code, design, graphics, text, and trademarks, is owned by Q&A IT and protected by intellectual property laws. These Terms do not transfer ownership of the App to you — only the limited right to use it as described.
The “Bar & Resto Menu” name and any associated marks are trademarks of Q&A IT.
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
The App is a business tool. You are responsible for verifying that orders, sales calculations, and other outputs are accurate before relying on them. We are not responsible for business decisions you make based on App outputs.
The App is designed for Android 8.0 and higher. Performance may vary by device. We do not guarantee compatibility with all devices.
To the maximum extent permitted by law, Q&A IT shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, revenue, business opportunities, lost or corrupted data, business interruption, or loss of goodwill.
Our total liability arising from or related to the App shall not exceed the greater of (a) the amount you paid for the license in the 12 months preceding the claim, or (b) USD 100.
This limitation does not apply to liability for gross negligence, willful misconduct, fraud, or where prohibited by law.
You agree to indemnify and hold harmless Q&A IT from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, your violation of any rights of a third party, or content or data you create or process within the App.
You may stop using the App at any time and cancel any active subscription. Uninstalling the App does not automatically cancel your subscription — you must cancel through the payment provider or by contacting us.
We may terminate your license immediately, without refund, if you materially breach these Terms, attempt to circumvent license verification, share your license key, use the App for unlawful purposes, or initiate a chargeback for your purchase.
Upon termination, your right to use the App ends. You must stop using the App and remove it from your devices. Sections 5, 8, 10, 11, 12, 13, 15, and 16 shall survive termination.
These Terms are governed by the laws of Bangladesh, without regard to conflict of laws principles. Any dispute shall be resolved exclusively in the courts of Dhaka, Bangladesh.
Before initiating formal legal action, the parties agree to attempt good-faith resolution through direct communication for at least 30 days.
We may update these Terms as the App evolves. The “Last Updated” date at the top indicates when changes were made. Material changes will be communicated within the App or via email to active license holders. Your continued use of the App after changes indicates acceptance of the updated Terms.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Q&A IT regarding the App. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not constitute a waiver.
